RESOLUTION NO. 1234
Resolution disapproving the petition for a revocable consent for an unenclosed sidewalk café located at 113 Seventh Avenue South, Manhattan (20055576 TCM; L.U. No. 608).

WHEREAS, the Department of Consumer Affairs filed with the Council on September 23, 2005 its approval of the petition dated September 23, 2005 of Cheers of Manhattan, Inc. (the “Applicant”), for a revocable consent to continue to maintain and operate an unenclosed sidewalk café located at 113 Seventh Avenue South, Community District 2, Borough of Manhattan, (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");
WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code;
WHEREAS, upon due notice, the Council held a public hearing on the Petition on October 24, 2005; and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Petition;
RESOLVED:
Pursuant to Section 20-226 of the Administrative Code, the Council disapproves the Petition.
