Resolution approving the decision of the City Planning Commission on ULURP No. C 010136 PPM, for the disposition in fee simple of a portion of city-owned property generally bounded by Eleventh Avenue, West 44th Street, the Consolidated Rail Company railroad right-of-way, and West 45th Street (Block 1073, part of Lot 1), and the disposition of approximately 112,970 square feet of development rights from a portion of city-owned property generally bounded by Eleventh Avenue, West 44th Street, the Consolidated Rail Company railroad right-of-way, and West 45th Street (Block 1073, part of Lot 1), Manhattan (L.U. WHEREAS, the City Planning Commission filed with the Council on February 22, 2001 its decision dated February 14, 2001 (the "Decision") on the application submitted pursuant to Section 197-c of the New York City Charter by the Department of Citywide Administrative Services and the Economic Development Corporation, that the disposition in fee simple of a portion of city-owned property generally bounded by Eleventh Avenue, West 44th Street, the Consolidated Rail Company railroad right-of-way, and West 45th Street (Block 1073, part of Lot 1), and the disposition of approximately 112,970 square feet of development rights from a portion of city-owned property generally bounded by Eleventh Avenue, West 44th Street, the Consolidated Rail Company railroad right-of-way, and West 45th Street (Block 1073, part of Lot 1), pursuant to zoning, Borough of Manhattan (ULURP No. C 010136 PPM) (the "Application");
WHEREAS, the Application is related to ULURP Application Number C 010137 (L.U. No. 1012), the grant of a special permit pursuant to Section 74-743 of the Zoning Resolution;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on March 20, 2001 and recessed until March 22, 2001;

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on September 11, 2001 (CEQR No. 01DME001M);
RESOLVED:
Pursuant to Section 197-d of the City Charter and on the basis of the Application and the Decision the Council approves the Decision.
