A Local Law to amend the administrative code of the city of New York, in relation to requiring the creation and dissemination of diversity, equity and inclusion training for educational leaders
Be it enacted by the Council as follows:
Section 1. Title 21-A of the administrative code of the city of New York is amended by adding a new chapter 44 to read as follows:
CHAPTER 44
DIVERSITY, EQUITY, AND INCLUSION TRAINING FOR EDUCATIONAL LEADERS
§ 21-1016 Diversity, equity, and inclusion training for educational leaders. a. Definitions. For purposes of this section, the following terms have the following meanings:
Community district education council. The term “community district education council” means a body created pursuant to section 2590-c of the education law, or one or more members thereof.
Educational leader. The term “educational leader” means a member of a community district education council or a council, association, or other multimember body that provides input on education policy and decisions in the city of New York, as established pursuant to subdivisions 2, 4, 5, 6 or 7 of section 2590-b or section 2590-h of the education law.
Implicit bias. The term “implicit bias” means an unconscious or unrecognized bias or prejudice against people of a particular race, ethnicity, gender, sexual orientation, linguistic background, economic class, or other social group that may influence a person’s actions or perceptions.
School diversity advisory group. The term “school diversity advisory group” means a group constituted pursuant to section 21-999.
b. No later than January 1, 2027, the department shall submit to the mayor, the speaker of the council, the chief equity officer, and any other office or agency designated by the mayor pursuant to subdivision c of this section a report containing:
1. the training and continuing education materials for community district education councils required by subdivision 7 of section 2590-e of the education law, or a detailed description thereof;
2. the complete set of requirements for providers, content and implementation of training and continuing education pursuant to subdivision 7 of section 2590-e of the education law; and
3. a description of issues pertaining to discrimination and inequity that have arisen with respect to community district education councils and other educational leaders in the course of carrying out their powers and duties, including those enumerated in section 2590-e of the education law.
c. No later than June 30, 2028, the chief equity officer or an office or agency to be designated by the mayor shall, in consultation with the department, create one or more training modules for educational leaders in relation to diversity, equity and inclusion. Such training shall be made available on request and administered by an office or agency to be designated by the mayor. The purpose of such training shall be to improve educational leaders’ ability to recognize, combat and prevent interpersonal, systemic and structural discrimination and inequity that may arise while carrying out their powers and duties. Such training shall address, at minimum, the following topics as they relate to each of the powers and duties in section 2590-e of the education law, and shall also cover how each of the following topics may reflect or pertain to anti-black racism:
1. The history and present-day impacts of systemic and structural discrimination and inequity in relation to New York City education laws and policies, including in relation to zoning, access to resources, curriculum, instructional methods, disciplinary policies, access to education, and educational outcomes;
2. The role and common manifestations of implicit bias in causing or perpetuating discrimination and inequity in educational settings, organizational culture, government procedure, and policymaking;
3. Relevant civil rights laws and human rights frameworks;
4. Best practices for promoting diversity, equity and inclusion in education and policymaking; and
5. Practical advice for recognizing, combating and preventing interpersonal and systemic discrimination and inequity that may arise in the course of carrying out the powers and duties of community district education councils or other educational leaders, including intervention or “upstander” training.
d. No later than June 30, 2028, the chief equity officer or office or agency designated by the mayor in subdivision c of this section to develop training materials shall, in consultation with the department, create unique versions of such training materials for each council, association, or other multimember body of educational leaders to ensure that the information covered is tailored to the powers and duties of each such council, association, or body.
e. If, prior to June 30, 2028, the department or a nonprofit provider authorized by the chancellor pursuant to section 2590-e of the education law develop training materials that substantially meets the requirements of subdivisions c, d, and f of this section, the requirements of such subdivisions and subdivision b shall be deemed fulfilled and no further action shall be required pursuant to those subdivisions.
f. In consultation with the department, the chief equity officer or office or agency designated by the mayor pursuant to subdivision c of this section shall ensure, to the extent practicable, that any training developed for community district education councils pursuant to this section complies with the requirements of subdivision 7 of section 2590-e of the education law, including any rules or regulations promulgated pursuant to such section.
g. The department shall post a notice of how to access any training materials developed pursuant to this section on the department’s website. Training materials developed pursuant to subdivision c of this section shall be posted in proximity to other training or continuing education materials for community district education councils.
h. Nothing in this section shall be construed to prohibit any training materials developed pursuant to this section from being added or incorporated, in part or in whole, into other training or continuing education materials that may be required pursuant to subdivision 7 of section 2590-e of the education law, to the extent permitted by law.
i. No later than October 31 of each year, the administering agency or entity for any training developed pursuant to this section shall submit to the mayor, the speaker of the council, and the school diversity advisory group, a report that lists, for each community district education council, the number of members who completed any such training in the preceding year. As applicable, such report shall also list, for each other council, association, or multimember body to which a diversity, equity and inclusion training was offered pursuant to this section, the number of members who completed such training in the preceding year. To the extent that any such training is added or incorporated, in part or in whole, into training or continuing education materials required pursuant to subdivision 7 of section 2590-e of the education law, the requirements of this subdivision shall be waived.
§ 2. This local law takes effect immediately.
