A Local Law to amend the administrative code of the city of New York, in relation to safety at highway construction sites.
Be it enacted by the Council as follows:
Section 1. Chapter one of title 10 of the administrative code of the city of New York is amended by adding a new section 10-161 to read as follows:
§10-161 Safety at highway construction sites. a. For purposes of this section, a "highway" shall mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
b. At least one police officer or traffic enforcement agent shall be assigned to every construction site on a highway to enforce traffic restrictions and street closures and, when necessary, to direct the flow of traffic where vehicular traffic on that highway or adjacent highways, bridges or tunnels is impeded by such construction.
§2. This local law shall take effect ninety days after its enactment into law, provided however, that the police department shall promulgate all rules necessary to implement this local law on or before its effective date.
