THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 1009 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 030325 ZMX, a Zoning Map change (L.U. No. 427). Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on July 3, 2003 its decision dated June 18, 2003 (the "Decision"), on the application submitted by Fordham University, pursuant to Sections 197-c and 201 of the New York City Charter, for an amendment to the Zoning Map (ULURP No. C 030325 ZMX) (the "Application"); WHEREAS, the Application is related to ULURP Applications Numbers C 030326 ZSX (L.U. No. 428) and C 030327 ZSX (L.U. No. 429), special permits pursuant Sections 74-512 and 74-53 of the Zoning Resolution, respectively; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on July 21, 2003; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on March 28, 2003, which includes (E designation) E-119 for noise (Block 3273, Lot 203); RESOLVED: The Council finds that the action described herein will have no significant effect on the environment. _________ Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the Decision. The Zoning Resolution of the City of New York, effective as of December 15, 1961, and as subsequently amended, is further amended by changing the Zoning Map, Section No. 3c: 1. changing from a C8-1 District to an R6 District property bounded by Crotona Avenue, East Fordham Road, Belmont Avenue, and the northeasterly terminus of Belmont Avenue and its southeasterly prolongation; and 2. establishing within an existing R6 District and a proposed R6 District a C2-3 District bounded by Dr. Theodore Kazimiroff (Southern) Boulevard, Crotona Avenue, East Fordham Road, Belmont Avenue and its northeasterly center line prolongation, and a line perpendicular to the last course distant 500 feet northeasterly (as measured along the last course) from the terminus of Belmont Avenue; as shown on a diagram (for illustrative purposes only) dated March 31, 2003 and subject to the conditions of CEQR Declaration E-119, Community District 6, Borough of the Bronx.
