A Local Law to amend the administrative code of the city of New York, in relation to civil penalties for failure to remove snow or ice
Be it enacted by the Council as follows:
Section 1. Section 16-123 of the administrative code of the city of New York is amended by adding a new subdivision k to read as follows:
k. In the event of snowfall or the formation of ice, the commissioner of transportation and the commissioner of parks and recreation shall submit to the commissioner, in writing or through electronic submission, a certification that the department of transportation and the department of parks and recreation have completed the removal of snow and ice from infrastructure under the respective jurisdictions of such departments, including but not limited to any street, curb, ramp, pathway, pedestrian bridge, underpass, overpass, plaza, greenway, playground, step street, or cantilever. The department shall not issue a notice of violation, appearance ticket, or summons to or on any person for a violation of subdivision a or b of this section, until:
1. Pursuant to section 16-124, the department has completed or caused to be completed the removal of snow and ice from streets immediately after snowfall or the formation of ice; and
2. Pursuant to this subdivision, the commissioner of transportation and the commissioner of parks and recreation have certified to the commissioner that the removal of snow and ice from infrastructure under the respective jurisdictions of such departments is complete.
§ 2. This local law takes effect 120 days after it becomes law.
