Summary: This bill would require NYPD to assign a security detail to any elected or appointed city official that receives a credible threat to their safety. The size, scope, and duration of the security detail would be left to the discretion of the NYPD commissioner. The elected or appointed official may opt-out of receiving a security detail.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the police department to provide security details to elected and appointed city officials that receive threats

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of Title 14 of the administrative code of the city of New York is amended by adding a new section 14-199 to read as follows:

§14-199 Security details for threatened officials. a. Definitions. For purposes of this section, the following terms have the following meanings:

Appointed official. The term “appointed official” means any person appointed by the mayor pursuant to section 6(a) of the charter.

Credible threat. The term “credible threat” means a threat that, upon assessment by the police department, is determined to present a legitimate concern for the elected or appointed official’s safety.

Elected official. The term “elected official” means any individual elected to a city office pursuant to the charter, or any person appointed to fill a vacancy in such office.

b. Security detail. Where the commissioner determines that a credible threat has been made against an elected or appointed city official, the commissioner shall provide a personal security detail to such official.

c. Scope. The size, scope, and duration of the security detail shall be at the discretion of the commissioner.  

d. Declination. An elected or appointed city official may decline the assignment of a security detail.

§ 2. This local law shall take effect immediately.
