A Local Law to amend the administrative code of the city of New York, in relation to bike share safety reporting
Be it enacted by the Council as follows:
Section 1. Subchapter 3 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-192 to read as follows:
§ 19-192 Bike share safety reporting. a. Definitions. For the purposes of this section, the following terms have the following meanings:
Bicycle. The term “bicycle” has the same meaning as set forth in subdivision a of section 19-176.
Bicycle with electric assist. The term “bicycle with electric assist” has the same meaning as set forth in section 102-c of the vehicle and traffic law.
Bike share device. The term “bike share device” means any bicycle or bicycle with electric assist that a bike share operator makes available as part of a bike share program.
Bike share operator. The term “bike share operator” means the company operating the city of New York’s bike share program under a contract entered into through the department.
Bike share program. The term “bike share program” means the providing of public bike share devices for shared use within the city of New York under a contract with an operator that permits payment for the use of such bike share devices.
Safety incident. The term “safety incident” means any of the following incidents that any party, including the bike share rider involved, has reported to the bike share operator:
1. A collision between a bike share device and a vehicle, pedestrian, cyclist, or any other person or structure during a bike share trip;
2. A traffic violation that occurs during a bike share trip;
3. A theft of a bike share device; or
4. An act of vandalism targeting a bike share device.
Injury. The term “injury” means any injury categorized as an “A” or “B” injury by the New York state department of motor vehicles, or any injury that requires hospitalization, or any injury as determined by the commissioner.
Member. The term “member” means an individual who, due to payment of a membership or subscription fee to a bike share program, is entitled to use a bike share device at no cost or a discounted cost for a period of no less than 10 days.
b. The commissioner shall require that, under the contract agreement between the city and the bike share operator regarding the bike share program, the following data be provided to the commissioner at least once a month for each safety incident:
1. Whether the safety incident was a collision, traffic violation, theft, or act of vandalism;
2. The location of the safety incident, in a format specified by the department;
3. Whether the bicycle involved in the safety incident is a bicycle or a bicycle with electric assist;
4. An estimate of the dollar amount of any property damage that occurred as a result of the safety incident;
5. For safety incidents involving a traffic violation, the type of traffic violation; and
6. For safety incidents involving a collision or traffic violation:
(a) The speed of the bike share device at the time of the safety incident;
(b) The types of objects, vehicles, or other road users involved;
(c) Whether the bike share rider involved in the safety incident was a member;
(d) The number of the bike share rider’s previous bike share rides;
(e) The bike share rider’s age;
(f) Whether any fatalities occurred as a result of the safety incident; and
(g) Whether an injury occurred as a result of the safety incident.
c. Within 6 months of the effective date of the local law that added this section, and every 6 months thereafter, the department shall publish a report on its website that compiles the safety incident information received pursuant to subdivision b of this section for the prior 6-month period.
§ 2. This local law takes effect 60 days after it becomes law.
