A Local Law to amend the administrative code of the city of New York, in relation to requiring the installation of fire sprinklers in certain below grade mercantile spaces.
Be it enacted by the Council as follows:
Section 1. Adding a new subdivision c to read as follows, as amended by local law number 16 for the year 1987, amends section 27-929 of the administrative code of the city of New York:
(c) Notwithstanding any other provision of this subchapter, the requirement to install a system of automatic sprinklers shall apply retroactively to any space classified in mercantile occupancy group C pursuant to subdivision f of section 27-954 where any item is stored, sold or used in a below grade area in an amount that requires a fire department permit. Installation of such system shall be completed on or before July first, two thousand two.
§2. Table 17-2 of article 4 of subchapter 17 of chapter 1 of title 27 of the administrative code of the city of New York, as amended by local law number 10 for the year 1999, is amended by amending line six to read as follows:

§3. Subdivision f of section 27-954 of the administrative code of the city of New York is amended to read as follows:
(f) Spaces in high rise buildings classified in mercantile occupancy group C, spaces classified in mercantile occupancy group C exceeding seventy-five hundred square feet in floor area or with an unenclosed stair or elevator between any two or more floors or below grade spaces where any item is stored, sold or used in an amount that requires a fire department permit.
§4. Subchapter 15 of chapter of title 27 of the administrative code of the city of New York is amended by adding a new section 27-4093.1 to read as follows:
§27-4093.1 Sprinklers. Notwithstanding any other provision of law, the storage, sale or use of paints, varnishes, lacquers or any other substance commonly used for painting, varnishing, staining or similar purposes in an amount which requires a fire department permit is prohibited in any below grade areas in any space classified in mercantile occupancy group C unless such below grade area is fully protected by a system of automatic sprinklers.
§5. This local law shall take effect immediately, provided, however, that any existing spaces requiring sprinklers pursuant to section four of this local law shall be brought into compliance no later than July first, two thousand two.
