Summary: This bill would require the Commissioner of Information Technology and Telecommunications to create a specific 311 service request category that allows individuals to file requests for service and complaints regarding the confinement of an incarcerated individual, or an issue, condition, practice, or action within city jails. The Commissioner would be required to publish a record of these service requests and update each service request to reflect its most recent status.

A Local Law to amend the administrative code of the city of New York, in relation to adding a 311 service request category for conditions of incarceration or confinement

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 3 of title 23 of the administrative code of the city of New York is amended by adding a new section 23-315 to read as follows:

§ 23-315 Conditions of incarceration or confinement service request. a. Definitions. For the purposes of this section, the following terms have the following meanings:

Commissioner. The term “commissioner” means the commissioner of information technology and telecommunications.

Incarcerated individual. The term “incarcerated individual” means any individual in the custody of the commissioner of correction.

b. Service request category. 1. The commissioner, in consultation with the commissioner of correction, shall implement and maintain through the 311 customer service center, mobile platform and any other platform that the center routinely uses to accept complaints, the capability for an individual to file a service request under the category of “condition of incarceration or confinement.” Such category shall include any request for service or complaint regarding the confinement of an incarcerated individual or an issue, condition, practice, or action within a facility under the control of the commissioner of correction.

2. An individual filing a service request under the category “condition of incarceration or confinement” shall have the ability to submit the following information with the service request:

(a) The identity of any relevant incarcerated individual;

(b) The identity of any relevant agency personnel;

(c) The housing facility and housing area type to which the service request relates;

(d) Whether the service request relates to or is duplicative of a different service request or complaint filed through the 311 customer service center or with the department of correction, and, if so, any known unique identifier or tracking number assigned to such request or complaint; and

(e) Whether the individual filing the service request is an incarcerated individual, an attorney or other advocate, a public official, or another third party.

c. Publication. The commissioner shall publish a record of each service request submitted under the category “condition of incarceration or confinement” in a public data set and update each such record to reflect the most recent status assigned to the service request.

§ 2.  This local law takes effect 120 days after it becomes law.
