Summary: This bill would require the Police Commissioner, in consultation with the Commissioner of Transportation, to train police officers on the enforcement of New York City rules on parking, stopping, and standing that are applicable to commercial vehicles, including trucks, and on truck routing. Police recruits would have to be trained as part of their police academy training and uniformed members of the Police Department would have to be trained every 2 years. The Police Commissioner must consult with the Commissioner of Transportation to periodically review, and revise as appropriate, the training curricula based on changes in rules and relevant Police Department policies.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the training of police officers on enforcement of commercial vehicle parking, stopping, and standing rules and truck routing rules

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 14 of the administrative code of the city of New York is amended by adding a new section 14-199.4 to read as follows:

§ 14-199.4 Commercial vehicle and truck violation enforcement training. a. Definitions. For purposes of this section, the following terms have the following meanings:

Commercial vehicle. The term “commercial vehicle” has the same meaning as set forth in the rules of the department of transportation for the purposes of the parking, stopping, and standing rules, and as may be amended from time to time.

Truck. The term “truck” has the same meaning as set forth in the rules of the department of transportation for the purposes of section 4-13 of title 34 of the rules of the city of New York, regarding truck routes, or a successor provision.

b. The commissioner, in consultation with the commissioner of transportation, shall train:

1. Police recruits, as part of their police academy training, on (i) the enforcement of parking, stopping, and standing rules applicable to commercial vehicles that are set forth in section 4-08 of title 34 of the rules of the city of New York, regarding parking, stopping, and standing, or a successor provision; and (ii) the enforcement of truck routing rules set forth in section 4-13 of title 34 of the rules of the city of New York, regarding truck routes, or a successor provision; and

2. All uniformed members of the department, every 2 years, on such enforcement.

c. The trainings required under this section shall include but not be limited to instruction on:

1. Parking, stopping, and standing rules specifically applicable to commercial vehicles;

2. Truck routing rules; and

3. Department policies on identifying, responding to, and investigating violations of such rules.

d. The commissioner, in consultation with the commissioner of transportation, shall periodically review and revise as appropriate the curricula for the trainings required under this section to account for relevant rules of the department of transportation that have been newly promulgated, modified, or repealed and for updates in relevant department policies.

§ 2. This local law takes effect 120 days after it becomes law.
