Whereas, The Department of Housing Preservation and Development (HPD) is responsible for creating and modifying the rules under which City-Aided Limited Profit Housing Companies, commonly referred to as the Mitchell-Lama developments, operate; and
Whereas, These rules govern such matters as tenant income limitations, the process for establishing and maintaining a waiting list, the limits on deposits and fees that may be charged, the procedures to be used to increase rents and carrying charges, lease termination and renewal, the rights of tenants and cooperators to create advisory councils and the housing companies' obligation to consult with the advisory councils; and
Whereas, Rule changes governing the operations of Mitchell-Lama properties have a significant impact on those individuals who reside within these developments; and
Whereas, Residents should be included in the decisions that affect them, a view clearly shared by HPD in providing for Tenant and Cooperator Advisory Councils within Mitchell-Lama developments; and
Whereas, HPD has signaled its intention to promulgate new rules for Mitchell-Lama developments in its annual rulemaking agenda; now, therefore, be it
Resolved, That the Council of the City of New York calls upon the Department of Housing Preservation and Development Resolution to include residents of City-Aided Limited Profit Housing Companies as significant participants in the process of revising the rules governing those companies and their properties.
