A Local Law to amend the administrative code of the city of New York, in relation to requiring the creation of an artificial intelligence model emergency response plan
Be it enacted by the Council as follows:
Section 1. Title 23 of the administrative code of the city of New York is amended by adding a new chapter 13 to read as follows:
CHAPTER 13
ARTIFICIAL INTELLIGENCE MODEL EMERGENCY RESPONSE PLAN
§ 23-1301 Definitions. As used in this chapter, the following terms have the following meanings:
Artificial intelligence model. The term “artificial intelligence” means an engineered or machine-based system that varies in its level of autonomy and that can, for explicit or implicit objectives, infer from the input it receives how to generate outputs that can influence physical or virtual environments.
Artificial intelligence model emergency. The term “artificial intelligence model emergency” means an event, or imminent threat thereof, involving an artificial intelligence model that, as determined by the office of cyber command and the emergency management department, compromises city-administered information systems or other critical infrastructure, or that causes significant disruption to the continuity of municipal government operations or to public health and welfare in the city.
Critical infrastructure. The term “critical infrastructure” means systems and assets, including telecommunication infrastructure, with the exception of residential and commercial buildings, that support vital city activities and for which the diminished functioning or destruction of such systems and assets would have a debilitating effect on public safety or economic security.
§ 23-1302 Artificial intelligence model emergency response plan. a. Plan. No later than 120 days after the effective date of the local law that added this section, the office of cyber command, in collaboration with the emergency management department, shall develop or update an artificial intelligence model emergency response plan and submit such plan to the mayor and speaker of the council. Such plan shall establish protocols to detect, assess, prepare for, mitigate, respond to, and recover from any artificial intelligence model emergency.
b. Updates. The office of cyber command, in collaboration with the emergency management department, shall review, and update as appropriate, the plan required under subdivision a of this section on an annual basis.
c. Progress reports. No later than 1 year after submission to the mayor and speaker of the council of the plan required under subdivision a of this section, and annually thereafter, the office of cyber command, in collaboration with the emergency management department, shall submit to the mayor and the speaker of the council a progress report identifying artificial intelligence model emergencies that occurred in the preceding 12 months and detailing the implementation of such plan.
d. Construction. No provision contained in this section shall be construed to interfere with the ability of an agency responding to an artificial intelligence model emergency to implement plans, modify plans, or take steps not described in the plan required under subdivision a of this section in a manner that is appropriate to circumstances particular to such artificial intelligence model emergency.
§ 2. This local law takes effect immediately.
