Title: A Local Law to amend the administrative code of the city of New York, in relation to prohibiting the sale and distribution of plastic confetti

Summary: This bill would prohibit the sale, offering for sale, or distribution to another person of confetti containing any amount of plastic material, including plastic confetti with a metallic coating. This prohibition would go into effect on December 31, 2026 and would be enforced by the Department of Consumer and Worker Protection (DCWP). First-time violators would not owe a civil penalty, but a second violation would incur a civil penalty of $150, a third violation would incur a civil penalty of $250, and a fourth and any subsequent violation would incur a civil penalty of $350. DCWP would be required to conduct outreach and education to retailers, wholesalers, and other vendors to raise awareness about the restrictions related to the sale and distribution of plastic confetti. In addition, the Police Department would be required to inform recipients of a permit for a parade, procession, or race of the prohibition on the sale and distribution of plastic confetti.

A Local Law to amend the administrative code of the city of New York, in relation to prohibiting the sale and distribution of plastic confetti

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 4 of title 20 of the administrative code of the city of New York is amended by adding a new subchapter 4 to read as follows:

SUBCHAPTER 4

CONFETTI

                     § 20-634 Sale, distribution of plastic confetti prohibited. a. Definitions. As used in this subchapter, the following terms have the following meanings:

Confetti. The term “confetti” means flat pieces of paper, plastic, or other material typically measuring between one-half inch and two-and-a-half inches in diameter or length and designed to be thrown or launched at a celebration or parade.

Plastic confetti. The term “plastic confetti” means confetti containing any amount of plastic material, and which may or may not have a metallic coating.

b. No person shall sell, offer for sale, or distribute plastic confetti to another person after December 31, 2026.

c. Any person who violates subdivision b of this section or any rule promulgated thereunder is liable for a civil penalty as follows:

1. For the first violation, a civil penalty of $0;

2. For the second violation, a civil penalty of $150;

3. For the third violation, a civil penalty of $250;

4. For the fourth and any subsequent violations, a civil penalty of $350.

§ 2. The commissioner of consumer and worker protection shall conduct outreach and education to retailers, wholesalers, and other vendors to inform them of the provisions of section one of this local law. Such outreach and education may continue, but shall not be required by this section to continue, after January 1, 2027.

§ 3. Paragraph 5 of subdivision a of section 10-110 of the administrative code of the city of New York is amended and a new paragraph 6 is added to such subdivision to read as follows:

5. The chief officer of any procession, parade or race, for which a permit may be granted by the police commissioner, shall be responsible for the strict observance of all rules and regulations included in said permit; and

6. The police commissioner shall inform the chief officer of any procession, parade or race, for which a permit is granted by the police commissioner, of the prohibition on the sale and distribution of plastic confetti set forth in section 20-634.

§ 4. This local law takes effect immediately.
