A Local Law to amend the New York city charter, in relation to setting limits on overtime spending by city agencies.

 

Be it enacted by the Council as follows:

 

                     Section 1.  Section 107 of chapter six of the New York City Charter is hereby amended by the addition of a new subdivision f to read as follows:

                     f.                     (1)                     Notwithstanding any other provisions of law, upon exceeding a schedule for overtime spending within any unit of appropriation, as set forth in the adopted budget for the current fiscal year, by the percentage established herein, each agency shall submit to the council a statement of its reasons justifying the need to increase such overtime spending allocation and a projection of its overtime spending needs for the remainder of the current fiscal spending quarter and balance of such fiscal year.  Such projection shall include a detailed summary of how such overtime expenditures will be allocated within the agency.

                                          (2)                     For each agency, the percentage increase of overtime spending, above which the provisions of this subdivision shall apply, is five percent of any schedule for overtime expenses within an agency's appropriation, as contained in the current fiscal year's adopted or modified budget.

                     §2.                     The reporting requirement prescribed herein shall not be construed to limit in any way the budgetary powers vested in the council pursuant to chapters six, nine and ten of the charter.

                     §3.                     This local law shall take effect on the first day of the fiscal year next proceeding its enactment.
