THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 1328 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 000101 ZSM (L.U. No. 732), grant of a special permit to allow the enlargement of an existing facility and to permit the allowable floor area ratio. Body By Council Members Eisland and McCaffrey WHEREAS, the City Planning Commission filed with the Council on March 22, 2000 its decision dated March 15, 2000 (the "Decision") on the application submitted by the Terence Cardinal Cooke Health Care Center, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-90 of the Zoning Resolution to permit the enlargement of an existing 694-bed nursing home with no increase in the number of beds; and Section 74-902 to permit the allowable community facility floor area ratio of Section 24-11 to apply to a proposed approximately 1,538 square foot enclosure of an existing terrace area of the existing nursing home on property located at 1249 Fifth Avenue (Block 1611/Lots 1 and 15) between East 105th Street and East 106th Street, within R9, R7-2 and C1-5/R7-2 Districts, Borough of Manhattan (ULURP No. C 000101 ZSM) (the "Application"); WHEREAS, the City Planning Commission has made the findings required pursuant to Sections 74-90 and 74-902 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on April 17, 2000 on the Decision and Application; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; _____________ Page 2 of 2 C 000101 ZSM Reso.
