RESOLUTION NO. 1789
Resolution approving the petition for a revocable consent for a small unenclosed sidewalk café located at 255 Fifth Avenue, Borough of Manhattan (20135404 TCM; L.U. No. 820).

WHEREAS, the Department of Consumer Affairs filed with the Council on April 15, 2013 its approval dated April 12, 2013 of the petition of HPA Restaurant, LLC, d/b/a Ben & Jack's Steakhouse, for a revocable consent to continue to maintain and operate a small unenclosed sidewalk café located at 255 Fifth Avenue, Community District 5, Borough of Manhattan (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");
WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(e) of the Administrative Code;
WHEREAS, upon due notice, the Council held a public hearing on the Petition on May 13, 2013; and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Petition;
RESOLVED:
Pursuant to Section 20-226 of the Administrative Code, the Council approves the Petition.
