A Local Law to amend the administrative code of the city of New York, in relation to establishing a private cause of action for certain harms arising from third-party misuse of artificial intelligence models

 

Be it enacted by the Council as follows:

 

Section 1. Title 10 of the administrative code of the city of New York is amended by adding a new chapter 12 to read as follows:

CHAPTER 12

ACTIONS FOR ARTIFICIAL INTELLIGENCE MODEL MISUSE

§ 10-1201 Definitions. For purposes of this chapter, the following terms have the following meanings:

Artificial intelligence model. The term “artificial intelligence model” means an engineered or machine-based system that varies in its level of autonomy and that can, for explicit or implicit objectives, infer from the input it receives how to generate outputs that can influence physical or virtual environments.

Artificial intelligence provider. The term “artificial intelligence provider” means any person that makes an artificial intelligence model available for commercial or public use.

Third-party user. The term “third-party user” means any person, other than the artificial intelligence provider, that uses an artificial intelligence model.

§ 10-1202 Private cause of action. a. A person may bring a civil action against an artificial intelligence provider for any harm occurring in the city when:

1. The harm was caused by a third-party user’s misuse or malicious use of an artificial intelligence model made available by the artificial intelligence provider, including circumvention of the ethical guardrails, content filters, or safety restrictions of such artificial intelligence model;

2. The artificial intelligence provider failed to implement reasonable safeguard against such misuse or malicious use; and

3. Such harm was foreseeable.

b. A person may bring a civil action pursuant to subdivision a of this section in any court of competent jurisdiction for damages, including punitive damages, injunctive relief and such other remedies as may be appropriate.

§ 2. This local law takes effect immediately.
