THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 1883

Resolution approving the decision of the City Planning Commission on ULURP No. C 090112 ZMQ, a Zoning Map amendment (L.U. No. 1021).

WHEREAS, the City Planning Commission filed with the Council on February 20, 2009 its decision dated February 18, 2009 (the "Decision"), on the application submitted by the Department of City Planning, pursuant to Sections 197-c and 201 of the New York City Charter, for an amendment to the Zoning Map to change from existing R5, R6 and R6B districts to lower-density or contextual R5, R5A and R6A zones (ULURP No. C 090112 ZMQ) (the "Application");

WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;

WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on March 18, 2009;

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and

                      WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on October 6, 20098 (CEQR No. 09DCP014Q);

RESOLVED:

                     The Council finds that the action described herein will have no significant effect on the environment.

Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, and based on the environmental determination and consideration described in this report, C 090112 ZMQ, incorporated by reference herein, the Council approves the Decision.

                     The Zoning Resolution of the City of New York, effective as of December 15, 1961, and as subsequently amended, is further amended by changing the Zoning Map, Section Nos. 9d, 10a, 10b:

1.                     changing from an R6B District to an R5 District property bounded by:

a.                           a line 100 feet southerly of 35^th Avenue, a line midway between 90^th Street and 91^st Street, a line 100 feet northerly of 37^th Avenue, and 90^th Street;

b.                           a line 100 feet southerly of 34^th Avenue, 93^rd Street, a line 100 feet northerly of 35^th Avenue, 92^nd Street, 35^th Avenue, a line midway between 93^rd Street and 94^th Street, a line 100 feet northerly of 37^th Avenue, a line midway between 91^st Street and 92^nd Street, 35^th Avenue, and 91^st  Street;

c.                           a line 100 feet southerly of 37^th Avenue, a line midway between 90^th Street and 91^st Street, a line 300 feet northerly of Roosevelt Avenue, Elmhurst Avenue, 92^nd Street, 37^th Avenue, a line midway between 94^th Street and 95^th Street, a line 100 feet southeasterly of 37^th Avenue, a line midway between Warren Street and Junction Boulevard, a line 100 northerly of Roosevelt Avenue, a line midway between 91^st Street and 92^nd Street, a line 200 feet northerly of Roosevelt Avenue, and 89^th Street;

d.                           35^th Avenue, 105^th Street, 34^th Avenue, 112^th Street, a line 100 northwesterly and northerly of 37^th Avenue, 106^th Street, 37^th Avenue, 107^th Street, 37^th Road, 104^th Street, a line 100 feet northwesterly of 37^th Avenue, and a line 100 feet northeasterly of 99^th Street;

e.                           a line 100 feet southeasterly of 37^th Avenue, a line100 feet southwesterly of 103^rd Street, 39^th Avenue, 99^th Street, a line 100 feet northwesterly of 39^th Avenue, and a line 100 feet northeasterly of 99^th Street; and

f.                          38^th Avenue, a line 125 feet northeasterly of 111^th Street, a line 125 feet northwesterly of Roosevelt Avenue, and a line 100 feet northeasterly of 108^th Street;

2.                     changing from an R5 District to an R5A District property bounded by a line 100 feet southerly of Northern Boulevard,  a line 100 feet westerly of 101^st Street, 34^th Avenue, 102^nd Street, 35^th Avenue, a line midway between Junction Boulevard and 97^th Street,  the southerly street line of Brice Road and its easterly and westerly prolongation, Junction Boulevard, 34^th Avenue, and a line 100 feet westerly of 96^th Street;

3.                     changing from an R6B District to an R5A District property bounded by:

a.                           35^th Avenue, a line midway between 91^st Street and 92^nd Street, a line 100 feet  northerly of 37^th Avenue, and a line midway between  90^th Street and 91^st Street;

b.                           a line 100 feet southerly of 37^th Avenue, 92^nd Street, Elmhurst Avenue,  a line 300 feet northerly of Roosevelt Avenue, and a line midway between  90^th Street and 91^st Street;

c.                           35^th Avenue, a line 100 feet northeasterly of 99^th Street, a line 100 feet northwesterly of 37^th Avenue, and a line 100 feet northeasterly of Junction Boulevard;

f.                           37^th Avenue, 111^th Street, a line 125 feet northwesterly of 38^th Avenue, 112^th Street, a line midway between 37^th Avenue and 38^th Avenue, a line 125 feet southwesterly of 114^th Street, a line 125 feet northwesterly of Roosevelt Avenue, a line 125 feet northeasterly of 111^th Street, 38^th Avenue, and a line 100 feet northeasterly of 108th Street; and

4.                     changing from an R6 District to an R6A District property bounded by:

a.                           Astoria Boulevard, 112^th Place, a line perpendicular to the easterly street line of 112^th Street distant 200 feet southerly (as measured along the street line) from the point of intersection of the easterly street line of 112^th Street and the southwesterly street line of Astoria Boulevard, a line midway between 111^th Street and 112^th Street, a line perpendicular to the westerly street line of 111^th Street distant 250 feet southerly (as measured along the street line) from the point of intersection of the westerly street line of 111^th Street and the southwesterly street line of Astoria Boulevard, a line midway between 110th Street and 111^th Street, a line perpendicular to the easterly street line of 110^th Street distant 150 feet southerly (as measured along the street line) from the point of intersection of the easterly street line of 110^th Street and the southwesterly street line of Astoria Boulevard, a line midway between 108^th Street and 110^th Street, the easterly prolongation of the southerly street line of 32^nd Avenue, and 108^th Street; and

b.                           a line 100 northerly of Northern Boulevard, 112^th Place, Northern Boulevard, a line 100 feet easterly of 112^th Street, a line 100 feet southerly of Northern Boulevard, 96^th Street, Northern Boulevard, and 95^th Street;
