Summary: This bill would require the Commissioner of Parks and Recreation to post signs at the entrances and exits of parks, and at certain park facilities, stating the rule prohibiting a person from leaving dog waste on the ground and the associated penalties for violation. Separately, this bill would require the Commissioner of Transportation to post signs on the New York State requirement concerning dog waste removal in public areas and associated penalties. The Commissioner of Transportation would have to consult with the Commissioner of Sanitation to learn of 311 requests for service or complaints concerning dog waste removal from sidewalks or pedestrian plazas, and then post these signs at the involved locations. Finally, the Commissioner of Transportation would be required to submit to the Mayor and the Speaker of the Council, and post online, an annual report on the posting of these signs.

A Local Law to amend the administrative code of the city of New York, in relation to the posting of signs on the prohibition of leaving dog waste on the ground

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 18 of the administrative code of the city of New York is amended by adding a new section 18-170 to read as follows:

§ 18-170 Signs on dog waste removal. a. The commissioner shall conspicuously post signs concerning dog waste removal at the entrance ways and exits of each park under the department’s jurisdiction.

b. The commissioner shall also conspicuously post such signs at the following park facilities under the department’s jurisdiction: playgrounds, beaches, fitness facilities, picnic areas, and dog runs.

c. Each sign required under this section shall state the departmental rule requiring a person in custody or control of a dog to promptly remove and dispose of any feces left by such dog in a park and the penalties for violating such rule.

§ 2. Subchapter 1 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-160.8 to read as follows:

§ 19-160.8 Signs on dog waste removal. a. Definitions. For purposes of this section, the term “pedestrian plaza” has the same meaning as set forth in section 19-157.

b. Consultation. The commissioner shall consult with the commissioner of sanitation once each month to obtain information on requests for service or complaints received by the department of sanitation from the 311 customer service center relating to the removal of dog feces on a sidewalk or pedestrian plaza.

c. Posting of signs. For each request for service or complaint that the department itself receives from the 311 customer service center relating to the removal of dog feces on a sidewalk or pedestrian plaza or on which the commissioner obtains information from the commissioner of sanitation under subdivision b of this section, the commissioner shall post on the relevant sidewalk or pedestrian plaza a sign stating the duty of each dog owner or person having possession, custody, or control of a dog to remove any feces left by such dog on any sidewalk, gutter, street, or other public area pursuant to section 1310 of the public health law, and the penalties for violating such law. If the commissioner determines such sidewalk or pedestrian plaza is not a feasible location to post a sign under this subdivision, the commissioner shall determine a nearby alternative location to post such sign. No more than 1 sign under this subdivision shall be posted on 1 city block.

d. Report. No later than 6 months after the effective date of the local law that added this section, and annually thereafter, the commissioner, in consultation with the commissioner of sanitation, shall submit to the mayor and speaker of the council, and post on the department’s website, a report on the commissioner’s posting of signs concerning dog waste removal under subdivision c of this section. The report shall include, but need not be limited to, the following information for the preceding 12 months:

1. The total number of signs posted;

2. The location of each sign posted;

3. The total number of requests for service or complaints received by the department or the department of sanitation from the 311 customer service center relating to the removal of dog feces on a sidewalk or pedestrian plaza, and the location for which each such request for service or complaint is made; and

4. The location of each sidewalk or pedestrian plaza for which the commissioner has determined posting a sign is not feasible, the reasons for such determination, and the alternative location chosen by the commissioner to post such sign.

§ 3. This local law takes effect 90 days after it becomes law.
