A Local Law to amend the administrative code of the city of New York, in relation to exempting retaining walls from the professional certification program.
Be it enacted by the Council as follows:
Section 1. Section 27-143 of the administrative code of the city of New York is amended to read as follows:
§27-143 Examination of application and plans. All applications for approval of plans and all plans submitted in connection therewith, and any amendments thereto, shall be numbered, docketed and examined promptly after their submission. The examination shall be made under the direction of the commissioner for compliance with the provisions of this code and other applicable laws and regulations. The commissioner may at his or her discretion, when the application is submitted by an architect or an engineer, designate portions of the examination for limited supervisory check, except as to any portion of such an application relating to retaining walls greater than three feet in height. The personnel employed for examination of plans shall be qualified engineers or architects experienced in building construction and design.
§2. Section 28-107 of the administrative code of the city of New York is amended by adding a new section 28-107.3.10 to read as follows:
§28-107.3.10 Exception. Notwithstanding the provisions of section 28-107.3, no portion of construction documents relating to retaining walls greater than three fee in height may be approved unless that portion has received a full examination by the department.
§3. This local law shall take effect sixty days from its enactment, except that section 2 shall take effect on July 1, 2008.
