Summary: The New York City Human Rights Law (HRL) prohibits discrimination on the basis of gender, and the Commission on Human Rights has issued legal guidance stating that this includes discrimination against someone for being intersex. This bill would amend the definition of “gender” to clarify that sex characteristics, including intersex traits, are included in the definition.

A Local Law to amend the administrative code of the city of New York, in relation to the definition of gender in the human rights law

 

Be it enacted by the Council as follows:

 

Section 1. The definition of “gender” in section 8-102 of the administrative code of the city of New York, as added by local law number 63 for the year 2018, is amended to read as follows:

Gender. The term “gender” includes actual or perceived sex, sex characteristics, including intersex traits, gender identity and gender expression, including a person’s actual or perceived gender-related self-image, appearance, behavior, expression or other gender-related characteristic, regardless of the sex assigned to that person at birth.

§ 2. This local law takes effect immediately.
