RESOLUTION NO. 1520
Resolution approving the decision of the City Planning Commission on an amended application submitted by the Department of Housing Preservation and Development, ULURP No. C 080220 HAM, approving the disposition of properties located at 346, 344, 342, 340, 352 and 350 St. Nicholas Avenue (Block 1954, Lots 20-23, 41 and 42); 311, 309, 307, 305 and 303 West 127th Street (Block 1954, Lots 24-28); 2373, 2375, 2377, 2379, and 2381 Frederick Douglass Boulevard (Block 1954, Lots 32-34 and 36); and 304, 306 and 308 West 128th Street (Block 1954, Lots 37-39) to a developer selected by the Department of Housing Preservation and Development (L.U. No. 749-A; C 080220 HAM).

WHEREAS, the City Planning Commission filed with the Council on May 12, 2008 its decision dated May 7, 2008 (the "Decision"), on the application submitted by the New York City Department of Housing Preservation and Development pursuant to Section 197-c of the New York City Charter and Article 16 of the General Municipal Law of New York State regarding:
a) the designation of properties located at 346, 344, 342, 340, 352 and 350 St. Nicholas Avenue (Block 1954, Lots 20-23, 41 and 42); 311, 309, 307, 305 and 303 West 127th Street (Block 1954, Lots 24-28); 2373, 2375, 2377, 2379 and 2381 Frederick Douglass Boulevard (Block 1954, Lots 32-36); and 304, 306 and 308 West 128th Street (Block 1954, Lots 37-39), as an Urban Development Action Area (the "Area");
b) an Urban Development Action Area Project for such area (the "Project"); and
pursuant to Section 197-c of the New York City Charter for the disposition of properties located at 346, 344, 342, 340, 352 and 350 St. Nicholas Avenue (Block 1954, Lots 20-23, 41 and 42); 311, 309, 307, 305 and 303 West 127th Street (Block 1954, Lots 24-28); 2373, 2375, 2377, 2379, and 2381 Frederick Douglass Boulevard (Block 1954, Lots 32-34 and 36); and 304, 306 and 308 West 128th Street (Block 1954, Lots 37-39), to a developer selected by the Department of Housing Preservation and Development to facilitate the development of three buildings, tentatively known as West 127th Street, with approximately 229 residential units and commercial space, to be developed under the Department of Housing Preservation and Development’s Cornerstone Program (the "Disposition"), Community District 10, Borough of Manhattan (ULURP No. C 080220 HAM) (the "Application");
WHEREAS, by letter dated and submitted June 25, 2008, the Department of Housing Preservation and Development amended the application to withdraw the actions requested pursuant to Article 16 of the General Municipal Law of New York State regarding: the designation of properties located at 346, 344, 342, 340, 352 and 350 St. Nicholas Avenue (Block 1954, Lots 20-23, 41 and 42); 311, 309, 307, 305 and 303 West 127th Street (Block 1954, Lots 24-28); 2373, 2375, 2377, 2379 and 2381 Frederick Douglass Boulevard (Block 1954, Lots 32-36); and 304, 306 and 308 West 128th Street (Block 1954, Lots 37-39), as an Urban Development Action Area (the "Area"); and an Urban Development Action Area Project for such area (the "Project");
WHEREAS, the Application is related to ULURP Application Number C 080219 ZMM (L.U. No. 748), a Zoning Map amendment;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;
WHEREAS, the New York City Department of Housing Preservation and Development ("HPD") submitted to the Council its recommendations regarding the Application on April 17, 2008;
WHEREAS, upon due notice, the Council held a public hearing on the Application and Decision on June 2, 2008;
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on December 26, 2007 (CEQR No. 03HPD020M);
WHEREAS, the Council has considered the land use and financial implications and other policy issues relating to the Application;
RESOLVED:
The Council finds that the action described herein will have no significant effect on the environment.
Pursuant to Section 197-d, the Council approves the decision of the City Planning Commission (C 080220 HAM).
The Council approves the disposition of properties located at 346, 344, 342, 340, 352 and 350 St. Nicholas Avenue (Block 1954, Lots 20-23, 41 and 42); 311, 309, 307, 305 and 303 West 127th Street (Block 1954, Lots 24-28); 2373, 2375, 2377, 2379, and 2381 Frederick Douglass Boulevard (Block 1954, Lots 32-34 and 36); and 304, 306 and 308 West 128th Street (Block 1954, Lots 37-39), to a developer selected by the Department of Housing Preservation and Development.
