THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 2141 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 010616 ZSK (L.U. No. 1126), a special permit pursuant to Section 62-736 of the Zoning Resolution. Body By Council Members Eisland and Linares WHEREAS, the City Planning Commission filed with the Council on October 31, 2001 its decision dated October 24, 2001 (the "Decision") on the application submitted by the Department of Housing Preservation and Development, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 62-736 of the Zoning Resolution to allow the modification of the maximum building height requirements of Section 62-351(c)(2), the maximum residential tower size of Section 62-351(c)(4), and the additional setback provisions of Section 62-351(c)(5), to facilitate the development of a 15-story and a 25-story mixed use development on a property located at 460 Kent Avenue (Block 2134/Lot 36), in R7-3 and R7-3/C2-4 Districts, Community District 1, Borough of Brooklyn (ULURP No. C 010616 ZSK) (the "Application"); WHEREAS, the Application is related to Applications Number C 010615 ZMK (L.U. No. 1125), a Zoning Map amendment, C 010619 HAK (L.U. No. 1127), a UDAAP designation, project approval and disposition of city-owned property, and N 010617 ZAK (L.U. No. 1278), an authorization pursuant Section 62-722 of the Zoning Resolution; WHEREAS, the City Planning Commission has made the findings required pursuant to Section 62-736 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on December 3, 2001 on the Decision and Application; ________ Page 2 of 2 C 010616 ZSK Reso. No. 1126) WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on May 4, 2001 (CEQR No. 01HPD011K); and WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; RESOLVED: The Council finds that the action described herein will have no significant effect on the environment; and Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council approves the Decision.
