Summary: This bill would require the New York City Police Department (NYPD) to report on the number of confirmed firearm discharges in the city on a weekly basis. NYPD would be required to report the date, time, and location of each firearm discharge, as well as a description of the circumstances of the discharge. This report would not include firearm discharges by NYPD officers acting within the scope of their duties.

A Local Law to amend the administrative code of the city of New York, in relation to weekly reporting on confirmed firearm discharges

 

Be it enacted by the Council as follows:

 

Section 1. Section 14-150 of the administrative code of the city of New York is amended by adding new subdivision g to read as follows:

g. Reporting on confirmed firearm discharges. 1. For purposes of this subdivision, the term “confirmed firearm discharge” means a firearm discharge, by any person other than a member of the department acting within the scope of their duties, that the department can corroborate with evidence recovered at the scene of the firearm discharge. Such evidence may include, but need not be limited to:

(a) Ballistics;

(b) Property damage;

(c) Shell casings;

(d) Live ammunition;

(e) Recovered firearms;

(f) Video;

(g) Firsthand witness accounts; and

(h) Victims.

2. The department shall, on a weekly basis, report on the number of confirmed firearm discharges. Such report shall include:

(a) The total number of confirmed firearm discharges, disaggregated by borough and by precinct;

(b) The approximate date, time, and location for each confirmed firearm discharge; and

(c) A description of the circumstances under which the firearms were discharged.

§ 2. This local law takes effect 120 days after it becomes law.
