Summary: This bill requires that DSNY identify and publish, on its website, all receptacle requirements for solid waste and recyclable material collected by DSNY at dwellings with 1 to 9 residential units. This bill further requires that DSNY shall deem receptacles as meeting all requirements if they were not designed or manufactured pursuant to a procurement process with the city but otherwise meet all receptacle requirements. Lastly, this bill cleans up the violation scheme in the amended section of the code by removing parentheses from around paragraph numbers, for consistency with all other parts of the section.

A Local Law to amend the administrative code of the city of New York, in relation to updating the receptacle requirements of the department of sanitation, and requiring the department to identify and publish receptacle requirements

 

Be it enacted by the Council as follows:

 

Section 1. Subdivision c of section 16-120 of chapter 1 of title 16 of the administrative code of the city of New York, as amended by local law number 110 for the year 2022, is amended by adding new paragraphs 5 and 6 to read as follows:

c. 5. Notwithstanding paragraphs 1, 2, and 3 of this subdivision and any rules promulgated pursuant to paragraphs 1, 2, and 3 of this subdivision, the department shall deem a receptacle as meeting the requirements of the department for the set-out of solid waste or recyclable material for collection by the department, pursuant to paragraph 2 of this subdivision, for dwellings containing 1 to 9 residential units if that receptacle meets all other requirements of the department except that the receptacle is not designed or manufactured pursuant to a procurement process with the city.

6. No later than the effective date of the local law that adds this paragraph, the department shall identify and publish on the website of the department all receptacle requirements, whether established by rule or by other means, for the set-out of solid waste or recyclable material for collection by the department for dwellings containing 1 to 9 residential units. No later than 30 days before any change to such requirements, the department shall identify and publish such changes on the website of the department.

§ 2. Subdivision f of section 16-120 of chapter 1 of title 16 of the administrative code of the city of New York, as amended by local law number 80 for the year 2021, is amended to read as follows:

f. Any person violating the provisions of this section, except subdivision e, shall be liable for a civil penalty of $50 for the first violation, $100 for a second violation within any twelve-month period, and $200 for a third or subsequent violation within any twelve-month period. Any person violating the provisions of paragraph [(1)] 1 of subdivision e of this section shall be liable for a civil penalty of $100 for the first violation, $250 for a second violation within any twelve-month period, and $350 for a third or subsequent violation within any twelve-month period. Any person violating the provisions of paragraph [(2)] 2 of subdivision e of this section shall be liable for a civil penalty $75 for the first violation, $300 for a second violation within any twelve-month period, and $400 for a third or subsequent violation within any twelve-month period.

§ 3. This local law takes effect 120 days after it becomes law, except that paragraph 5 takes effect immediately, and that the commissioner shall take such measures as are necessary for the implementation of this local law, including the promulgation of rules, before such date.
