A Local Law to amend the administrative code of the city of New York, in relation to requiring the provision of medical services at city hospitals to victims of sexual offenses.

 

Be it enacted by the Council as follows:

 

                     Section 1.  Chapter one of title 17 of the administrative code of the city of New York is amended by adding a new section 17-179 to read as follows:

                     §17-179  Certified sexual assault nurse examiners.  a.  Each City hospital providing emergency medical treatment within the City of New York shall provide a victim of a sexual offense with appropriate medical treatment within thirty minutes of the victim's arrival at the hospital.  Medical personnel rendering treatment to such victim shall include a rape crisis counselor and a nurse examiner who has received specialized training in forensic examination of sexual offense victims and the preservation of forensic evidence in such cases, as required pursuant to rules promulgated by the commissioner.

                     b.                     The commissioner shall promulgate such rules as may be necessary for the purpose of implementing the provisions of this section.

                     §2.                     This local law shall take effect thirty days after its enactment.
