Title: A Local Law to amend the administrative code of the city of New York, in relation to reporting data about micromobility device crashes

Summary: This bill would amend traffic crash reporting requirements for both the Police Department (NYPD) and Department of Transportation (DOT) to include data on micromobility devices as opposed to just bicycles. NYPD would be required to regularly report data on the number of traffic crashes between micromobility devices, as well as between such devices and pedestrians and motor vehicles, and include further breakdowns by micromobility device type and class. DOT would be required to consult with NYPD as well as the Fire Department, Department of Health and Mental Hygiene, and Health and Hospitals Corporation to compile data and provide an annual report on the number of micromobility device crashes reported to city agencies. DOT would also be required to maintain and update an interactive map of such data. The report and map would need to include further breakdowns of such data including by number of injuries and fatalities, location, time, and type and class of micromobility device involved.

A Local Law to amend the administrative code of the city of New York, in relation to reporting data about micromobility device crashes

 

Be it enacted by the Council as follows:

 

Section 1. Subdivision a of section 14-153 of the administrative code of the city of New York, as added by local law number 12 for the year 2011, is amended to read as follows:

a. The department shall publish on its website the following traffic-related data: (1) the number of moving violation summonses issued, disaggregated by type of summons; (2) the number of traffic crashes, disaggregated by (i) the type, and when applicable, class of each vehicle [or vehicles] and micromobility device involved and (ii) the number of motorists, [and/or injured] passengers, bicyclists, micromobility device users, and pedestrians involved; and (3) the number of traffic-related fatalities and injuries disaggregated by (i) the number of motorists, [and/or injured] passengers, bicyclists, micromobility device users, and pedestrians involved; and (ii) the apparent human contributing factor or factors involved in the crash, including, but not limited to alcohol, driver inattention/distraction, speeding, failure to yield and use of cell phones or other mobile devices. For purposes of this subdivision, the term “micromobility device” means a device intended for personal transportation within the city of New York that is not a motor vehicle as defined in section 125 of the vehicle and traffic law. The term “micromobility device” includes, but is not limited to, bicycles, bicycles with electric assist as defined in section 102-c of the vehicle and traffic law, scooters, and electric scooters as defined in section 114-e of the vehicle and traffic law.

§ 2. Section 19-186 of the administrative code of the city of New York, as added by local law number 13 for the year 2011, is amended to read as follows:

§ 19-186 Compilation of [bicycle] micromobility device crash data. a. The [department] commissioner shall, in consultation with the police department, fire department, department of health and mental hygiene, New York city health and hospitals corporation, and any other agency or entity deemed relevant by the commissioner, compile the total number of [bicycle] micromobility device crashes that are reported to city agencies. Such [bicycle] micromobility device crash compilation shall include crashes between [bicycles] micromobility devices, between [bicycles] micromobility devices and [motorized] motor vehicles, [and] between [bicycles] micromobility devices and pedestrians, and involving single micromobility devices, which shall include crashes with fixed objects and as a result of loss of control. [The department shall commence compiling such data on October 1, 2011.]

b. [On June 1, 2012 and annually thereafter,] By June 1 of each year, the [department] commissioner shall, in consultation with the police department, fire department, department of health and mental hygiene, New York city health and hospitals corporation, and any other agency or entity deemed relevant by the commissioner, provide a report to the council for the preceding calendar year, with such report posted on the department’s website, of the total number of reported crashes as required by subdivision a of this section, disaggregated by those involving solely [bicycles] micromobility devices, between [bicycles] micromobility devices and [motorized] motor vehicles, [and] between [bicycles] micromobility devices and pedestrians, and involving single micromobility devices, which shall include crashes with fixed objects and as a result of loss of control. [Such report shall also include the number of injuries and fatalities resulting from such crashes disaggregated as above. Such report shall also be disaggregated by borough and by police precinct.]

c. The commissioner shall maintain on the department’s website a publicly accessible, interactive map of all crash data compiled pursuant to subdivision a of this section that contains valid geographic information. Such map shall be updated at least monthly.

d. All compilations of information and reporting required by this section shall include citations identifying sources for any data used or referenced. To the extent such information is made available to the commissioner, all compilations of information and reporting required by this section shall also include micromobility device crash data disaggregated by the following categories:

1. Number of resulting injuries and fatalities;

2. Borough and police precinct in which crashes occurred or were reported;

3. Time during which crashes occurred or were reported; and

4. Type and class, when applicable, of micromobility device involved.

e. For purposes of this section, the term “micromobility device” means a device intended for personal transportation within the city of New York that is not a motor vehicle as defined in section 125 of the vehicle and traffic law. The term “micromobility device” includes, but is not limited to, bicycles, bicycles with electric assist as defined in section 102-c of the vehicle and traffic law, scooters, and electric scooters as defined in section 114-e of the vehicle and traffic law.

§ 3. This local law takes effect immediately.
