Res. No. 1632 Title Resolution finding that submission by the Department of Sanitation of a proposed comprehensive solid waste management plan modification conforms to the state environmental quality review act. Body By The Speaker (Council Member Vallone) and Council Members Michels, Clarke, Dear, Linares, Moskowitz, Nelson, O'Donovan, Pinkett, Fiala and Stabile; also Council Member Foster Whereas, The Department of Sanitation has prepared and presented to the Council, pursuant to section 360-15.11 of Title 6 of the Official Compilation of the Codes, Rules and Regulations of the State of New York and the Comprehensive Solid Waste Management Plan for the City of New York, a Proposed Comprehensive Solid Waste Management Plan Modification dated May 2000 which, as revised, is to be submitted to the New York State Department of Environmental Conservation; and Whereas, The Department of Sanitation has also issued a Notice of Completion for a Final Environmental Impact Statement in conjunction with such Proposed Comprehensive Solid Waste Management Plan Modification; and Whereas, The Council has considered the relevant environmental issues and such Final Environmental Impact Statement; now, therefore, be it Resolved, That the Council of the City of New York, having considered the Final Environmental Impact Statement, hereby finds that: (1) the requirements of The State Environmental Quality Review Act and Part 617 of Title 6 of the Official Compilation of the Codes, Rules and Regulations of the State of New York have been met; (2) consistent with social, economic and other essential considerations, from among the reasonable alternatives thereto, the proposed action is one which minimizes or avoids adverse environmental effects to the maximum extent possible, including the effects disclosed in the Final Environmental Impact Statement; and (3) consistent with social, economic and other essential considerations, to the maximum extent practicable, adverse environmental effects revealed in the environmental impact statement process will be minimized or avoided by incorporating as conditions in the Proposed Comprehensive Solid Waste Management Plan Modification those mitigative measures which were identified as practicable; and (4) the Proposed Comprehensive Solid Waste Management Plan Modification and the Final Environmental Impact Statement constitute the written statement of facts and conclusions, and of social, economic and other facts and standards that form the basis of this determination.
