Resolution authorizing the filing of applications for State assistance for development of tourism destination facilities and infrastructure to help create or retain business activity within the City of New York.

WHEREAS, The Empire State Development Corporation provides financial assistance from the Empire Opportunity Fund for development of recreational tourism destinations; and
WHEREAS, The Empire Opportunity Fund Program, established pursuant to Chapter 84 of the Laws of 2002, requires that the City Council of the City of New York adopt findings concerning the City's proposed recreational tourist development projects; and
WHEREAS, The City of New York Department of Parks and Recreation has prepared applications for four Empire Fund Opportunity Fund tourism destination projects, which are identified in the list attached to this Resolution and incorporated herein by this reference as Attachment No. 1; and
WHEREAS, The City finds that the proposed Barretto Point Park project, which renovates a waterfront pier as a municipal park, is consistent with the City's New Waterfront Revitalization Program and New York City Department of Parks and Recreation Recovery Action Plan ("Recovery Action Plan"); that the proposed financing is appropriate for the proposed Barretto Point Park project; that the Barretto Point Park project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and that the Barretto Point Park project develops the Park in a manner that will attract, create and sustain long-term employment opportunities; and
WHEREAS, The City of New York finds that the proposed Greenpoint Waterfront Park and Pier project is consistent with the Greenpoint 197-a Waterfront Plan; that the proposed financing is appropriate for the proposed Greenpoint Waterfront Park and Pier project; that the Greenpoint Waterfront Park and Pier project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and that the Greenpoint Waterfront Park and Pier project develops the Park in a manner that will attract, create and sustain long-term employment opportunities; and
WHEREAS, The City of New York finds that the proposed 59th Street Recreation Center project is consistent with the Recovery Action Plan; that the proposed financing is appropriate for the proposed 59th Street Recreation Center project, that the proposed 59th Street Recreation Center project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and the proposed 59th Street Recreation Center project develops the Center in a manner that will attract, create and sustain long-term employment opportunities; and
WHEREAS, The City of New York finds that the Greenbelt Recreation Center project is consistent with the Recovery Action Plan; that the proposed financing is appropriate for the proposed Greenbelt Recreation Center project, that the Greenbelt Recreation Center project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and that the Greenbelt Recreation Center project develops the Center in a manner that will attract, create and sustain long-term employment opportunities; and
WHEREAS, the City of New York Department of Parks and Recreation is the agency charged with the management and physical improvement of all designated parkland owned by the City of New York; now, therefore, be it
RESOLVED by the Council of the City of New York that:
1. The filing of an application for such state assistance payments for the projects specified in Attachment No. 1 in the form required by the Empire State Development Corporation, in conformity with the applicable laws of the State of New York, including all understandings and assurances required by said applications, is hereby authorized;
2. The City finds that the proposed Barretto Point Park project, which renovates a waterfront pier as a municipal park, is consistent with the City's New Waterfront Revitalization Program and Recovery Action Plan; that the proposed financing is appropriate for the proposed Barretto Point Park project; that the Barretto Point Park project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and that the Barretto Point Park project develops the Park in a manner that will attract, create and sustain long-term employment opportunities;
3. The City of New York finds that the proposed Greenpoint Waterfront Park and Pier project is consistent with the Greenpoint 197-a Plan; that the proposed financing is appropriate for the proposed Greenpoint Waterfront Park and Pier project; that the Greenpoint Waterfront Park and Pier project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and that the Greenpoint Waterfront Park and Pier project develops the Park in a manner that will attract, create and sustain long-term employment opportunities;
4. The City of New York finds that the proposed 59th Street Recreation Center project is consistent with the Recovery Action Plan; that the proposed financing is appropriate for the proposed 59th Street Recreation Center project, that the proposed 59th Street Recreation Center project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and the proposed 59th Street Recreation Center project develops the Center in a manner that will attract, create and sustain long-term employment opportunities;
5. The City of New York finds that the Greenbelt Recreation Center project is consistent with the Recovery Action Plan; that the proposed financing is appropriate for the proposed Greenbelt Recreation Center project, that the Greenbelt Recreation Center project facilitates effective and efficient use of existing and future public resources so as to promote economic development and conservation of natural resources; and that the Greenbelt Recreation Center project develops the Center in a manner that will attract, create and sustain long-term employment opportunities;
6. Adrian Benepe, as Commissioner of the City of New York Department of Parks and Recreation, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the Empire State Development Corporation in accordance with the program guidelines of the Empire Opportunity Fund and Chapter 84 of the Laws of 2002 for each proposed project, in an amount not to exceed the amounts specified in each application, to act in connection with each such application for state assistance payments, and upon approval by the Empire State Development Corporation for such projects to enter into and execute a project agreement with the Empire State Development Corporation for such financial assistance for each said approved application;
7. Sixteen (16) certified copies of this Resolution shall be prepared for forwarding to the Empire State Development Corporation.
