RESOLUTION NO. 976

Resolution approving a motion to file pursuant to the withdrawal of the surrender of real property located at 149 Rockaway Beach Boulevard, Queens (20075390 HHQ; Preconsidered L.U. No. 486).

                           WHEREAS, the New York City Health and Hospitals Corporation, filed with the Council on April 13, 2007, notice of the Board of Directors authorization dated April 6, 2007 of the surrender to the City of New York of approximately 5.6 acres including three buildings with approximately 125,000 square feet of floor area located at 149 Rockaway Beach Boulevard in Neponsit, New York, bounded by Neponsit Beach Boulevard to the north, the Neponsit residential community to the east, Jacob Riis Park to the west and the Atlantic Ocean to the south (formerly the Neponsit Health Center), upon the terms and conditions set forth in the Health and Hospitals Corporation resolution authorizing the surrender;

                           WHEREAS, the Surrender is subject to review and action by the Council pursuant to Section 7385(6) of the Health and Hospitals Corporation’s Enabling Act;

WHEREAS, by letter dated July 20, 2007, the New York City Health and Hospitals Corporation withdrew the Authorization for the Surrender.

RESOLVED:

                     The Council approves the motion to file pursuant to withdrawal of the application and pursuant to Rules 6.40a and 11.80 of the Rules of the Council.
