A Local Law in relation to the development of model procurement staffing plans for human services agencies and a report on feedback from human services agencies about such plans
Be it enacted by the Council as follows:
Section 1. a. Definitions. For the purposes of this section, the following terms have the following meanings:
City chief procurement officer. The term “city chief procurement officer” means the individual to whom the mayor has delegated authority to coordinate and oversee the procurement activity of mayoral agency staff, including the agency chief contracting officers and any offices that have oversight responsibility for procurement.
Human services agency. The term “human services agency” means a city agency that contracts with third party clients to provide social services including but not limited to day care, foster care, home care, health or medical services, housing and shelter assistance, preventive services, youth services, the operation of senior centers, employment training and assistance, vocational and educational programs, legal services, and recreation programs.
b. Model human services agency procurement staffing plans. The city chief procurement officer shall, in consultation with human services agencies and the office of nonprofit services, develop model procurement staffing plans for human services agencies and shall submit the model staffing plans to the mayor and the speaker of the council no later than 180 days after the effective date of this local law. Each model staffing plan shall be scaled to the amount of procurement work undertaken by a human services agency, quantified by the average number or total value of contracts processed per year, and shall set forth recommended staffing specifications for managing the applicable amount of procurement work in compliance with the schedules set forth in rules promulgated pursuant to section 6-148. Each model procurement staffing plan shall include:
1. A recommended minimum number of procurement employees;
2. A list of recommended procurement employee titles, organized by level of seniority;
3. Job descriptions for each recommended procurement employee title identified pursuant to paragraph 2 of this subdivision, including responsibilities and requisite experience or skills; and
4. A sample organizational chart.
c. Distribution and discussion with human services agencies. Upon submission of the model procurement staffing plans described in subdivision b of this section, the city chief procurement officer shall distribute the model procurement staffing plans to human services agencies and shall make best efforts to discuss the contents of the model procurement staffing plans with human services agencies and solicit feedback from human services agencies regarding conformance with such plans.
d. Report. No later than 180 days after the submission of the model procurement staffing plans described in subdivision b of this section, the city chief procurement officer shall submit to the mayor and the speaker of the council a report on the steps the city chief procurement officer has taken to distribute and discuss the model procurement staffing plans with human services agencies and the feedback received from such agencies regarding conformance with such plans. Such report shall include:
1. A list of human services agencies to which the city chief procurement officer has distributed the model procurement staffing plans pursuant to subdivision c of this section, and the dates of distribution;
2. A list of human services agencies with which the city chief procurement officer discussed the model procurement staffing plans pursuant to subdivision c of this section, and the dates when such discussions occurred;
3. A summary of the feedback received by each human services agency regarding the model procurement staffing plans, including potential challenges that would prevent such agencies from conforming to such plans;
4. A comparison of current and budgeted staffing levels at each human services agency to the model procurement staffing plans described in subdivision b of this section; and
5. Recommendations by the chief procurement officer regarding human services agency staffing, including but not limited to whether to monitor staffing levels for continued contracts.
§ 2. This local law takes effect immediately.
