A Local Law to amend the administrative code of the city of New York, in relation to prohibiting no-pet clauses from leases for unsubsidized units in multiple dwellings
Be it enacted by the Council as follows:
Section 1. Article 1 of subchapter 2 of chapter 2 of title 27 of the administrative code of the city of New York is amended by adding a new section 27-2009.1.1 to read as follows:
§ 27-2009.1.1 No-pet clauses in leases for unsubsidized housing. a. Where the owner of a multiple dwelling unit offered for rent receives no city financial assistance, as such term is defined in subdivision a of section 26-901, neither the owner nor any agent of such owner shall include, enforce, or cause to be enforced a lease provision prohibiting the harboring of a household pet, provided that the harboring of such household pet is not otherwise prohibited by the multiple dwelling law, the housing maintenance code of the city of New York, the health code of the city of New York, or any other applicable law. Any such restriction shall be unenforceable and deemed void.
b. This section shall not be construed to abolish or impair an owner’s existing rights to seek remedies when a household pet causes damage to the subject premise, creates a nuisance, or interferes substantially with the health, safety or welfare of other tenants or occupants of the same or an adjacent building or structure.
c. This section shall not apply to lease agreements entered into prior to July 1, 2026.
§ 2. This local law takes effect immediately.
