Summary: This bill would require the NYC Department of Sanitation (DSNY) to remove snow and ice from any bus stop or bus shelter when DSNY receives at least 5 complaints from persons who identify as having a disability that a property owner has failed to timely complete required snow removal from an abutting bus stop, bus shelter, or the sidewalk path between any such bus stop or bus shelter and the gutter, within 7 hours of receiving such complaints. This bill would also require DSNY to establish a public citywide map for tracking the status of snow removal from bus stops and shelters following snowfall or ice accumulations.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the department of sanitation to clear certain bus stops and bus shelters of snow and ice and to establish a public online map to track the status of snow clearance from bus stops and bus shelters

 

Be it enacted by the Council as follows:

 

Section 1. Subdivision d of section 16-123 of the administrative code of the city of New York is amended to read as follows:

d. Whenever any owner, lessee, tenant, occupant, or other person having charge of any building or lot of ground, abutting upon any street or public place where the sidewalk is paved, shall fail to comply with the provisions of this section, the commissioner may cause such removal to be made. No later than 7 hours after the department receives at least 5 complaints that any person has failed to complete snow removal pursuant to subdivision (a) of this section from any bus stop, bus shelter, bus boarding or alighting area, or sidewalk path leading from any bus stop or bus shelter to the nearest curb cut connecting to a crosswalk, the commissioner shall dispatch employees of the department to cause such snow removal to be made. Snow removal from any bus boarding or alighting area or sidewalk path leading from any bus stop or bus shelter to the nearest curb cut connecting to a crosswalk conducted by the department shall provide a width of not less than 48 inches, to the extent physically practicable. For purposes of this subdivision, the terms “bus shelter” and “bus stop” have the same meanings as set forth in section 16-124.1. This subdivision shall not be construed to eliminate or diminish the responsibility of any owner, lessee, tenant, occupant, or other person having charge of any building or lot of ground in the city, abutting upon any street where the sidewalk is paved to remove snow or ice, dirt, or other material from the sidewalk and gutter pursuant to this section.

§ 2. Section 16-124 of the administrative code of the city of New York is amended to read as follows:

a. The commissioner, immediately after every snowfall or the formation of ice on the streets, shall forthwith cause the removal of the same, and shall keep all streets clean and free from obstruction.

b. No later than January 31, 2027, the commissioner, in consultation with the department of information technology and telecommunications and the department of transportation, shall publish and maintain a page on the department’s website that allows members of the public to track, in real time, the status of the department’s removal of snow and ice from any bus stop or bus shelter conducted pursuant to subdivision d of section 16-123 after every snowfall or the formation of ice on city streets.

§ 3. This local law takes effect immediately.
