Resolution ratifying the memorandum of understanding entered into pursuant to chapter 175 of the laws of 2003 in connection with the Croton water filtration facility and the funding of certain eligible projects in the borough of the Bronx.

WHEREAS, on July 21, 1999, the Council approved the siting of a water filtration facility for the Croton water supply at a site at the Mosholu Golf Course, Van Cortlandt Park, in the Borough of the Bronx;

WHEREAS, the State Legislature enacted Chapter 175 of the Laws of 2003, authorizing the City of New York to discontinue the use of certain lands as park lands in connection with the construction, installation, operation and maintenance of said facility, provided that the City enter into a memorandum of understanding with the President Pro Tempore of the New York State Senate and the Speaker of the New York State Assembly identifying (1) the sum of money that the City shall dedicate for the purpose of implementing eligible projects to acquire and/or improve park lands in the borough of the Bronx and (2) a list of such eligible projects (“Memorandum of Understanding”), and that the Memorandum of Understanding be ratified by the Council; and

WHEREAS the Memorandum of Understanding has been entered into by the City, the President Pro Tempore of the New York State Senate and the Speaker of the New York State Assembly;

RESOLVED: The Council hereby ratifies the Memorandum of Understanding pursuant to Chapter 175 of the Laws of 2003.
