A Local Law to amend the New York city charter and the administrative code of the city of New York, in relation to eligibility for and access to special vehicle identification parking permits
Be it enacted by the Council as follows:
Section 1. Subparagraph e of paragraph (15) of subdivision a of section 2903 of the New York city charter, as amended by local law number 22 for the year 2002, is amended to read as follows:
(e) Certifications by the department of health and mental hygiene of applications for special vehicle identification permits shall be made at those district health offices designated for such purpose by the commissioner of health and mental hygiene. At least one such district health office shall be designated in each borough for special vehicle identification permit certifications. Such certifications shall be available by appointment at each of said borough health offices, or an alternative location within the borough as designated by the commissioner by regulation, on a regular basis. Such certifications may also be provided to the department of health and mental hygiene by a practitioner of medicine licensed pursuant to article 131 of the education law, nurse practitioner licensed pursuant to article 139 of the education law, or physician assistant licensed pursuant to article 131-b of the education law.
§ 2. Paragraph (15) of subdivision a of section 2903 of the New York city charter is amended by adding a new subparagraph f to read as follows:
f. Upon the filing of an application for a special vehicle identification permit pursuant to subparagraph (a) of this paragraph, the commissioner shall issue to such person in physical or digital format at no cost a provisional special vehicle identification parking permit which shall be deemed expired upon the approval of such application and issuance of a special vehicle identification permit to such person, upon denial of such application, or upon a finding of abuse by any person of any privilege, benefit, or consideration granted by such provisional permit.
§ 3. Subchapter 2 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-162.6 to read as follows:
§ 19-162.6 Special vehicle identification parking permits; electronic application portal. a. Definitions. For purposes of this section, the term “special vehicle identification permit” means a permit issued by the department pursuant to paragraph 15 of subdivision a of section 2903 of the charter.
b. Online application portal. The department, in consultation with the department of health and mental hygiene, shall establish and maintain a publicly accessible and secure online portal with a mobile-friendly responsive design which shall facilitate the processes and procedures for obtaining a special vehicle identification permit. Such portal shall be made available in the designated citywide languages as set forth in section 23-1101. Such portal shall also include secure medical provider upload functionality for the purpose of submitting medical certifications pursuant to subparagraph e of paragraph 15 of subdivision a of section 2903 of the charter. Such portal shall allow a user to, at minimum, perform the following functions:
1. Submit a new application for a special vehicle identification permit;
2. Renew a special vehicle identification permit;
3. Upload any required supporting documentation, including, but not limited to, medical certifications and records;
4. Authorize and receive application status notifications by electronic mail and text message; and
5. View the status of an application, including whether such application is deemed complete and the date on which any application determination is made.
c. The department shall maintain a physical, non-online application method for obtaining a special vehicle identification permit.
§ 4. This local law takes effect 120 days after it becomes law.
