A Local Law to amend the administrative code of the city of New York, in relation to prohibiting public disclosure of the addresses of certain shelter facilities

 

Be it enacted by the Council as follows:

 

Section 1. Subchapter 1 of chapter 1 of title 3 of the administrative code of the city of New York is amended by adding a new section 3-195 to read as follows:

§ 3-195. a. Definitions. As used in this chapter, the following terms have the following meanings:

Judicial warrant. The term “judicial warrant” means a warrant based on probable cause and issued by a judge appointed pursuant to article III of the United States constitution or a federal magistrate judge appointed pursuant to 28 U.S.C. § 631, that authorizes federal immigration authorities to take into custody the person who is the subject of such warrant.

New arrivals. The term “new arrivals” means individuals, adult families, and families with minor children who have arrived in the United States from other nations during the period beginning on March 15, 2022, and are seeking shelter from the city of New York.

b. No agency or mayoral office that operates emergency or temporary shelter facilities exclusively serving new arrivals shall publicly disclose the address or location of any such shelter facility unless such disclosure is required by a judicial warrant or otherwise required by law.

c. Notwithstanding the foregoing, no agency or mayoral office shall take any action in accordance with this section in violation of 8 U.S.C. § 1324.

§ 2. This local law takes effect immediately.
