A Local Law to amend the administrative code of the city of New York, in relation to prohibiting restrictions that bar the display of religious items on entry doors and doorframes
Be it enacted by the Council as follows:
Section 1. Section 8-107 of the administrative code of the city of New York is amended by adding a new subdivision 33 to read as follows:
33. (a) Except as provided in paragraph (b) of this subdivision, it shall be an unlawful discriminatory practice for any person to (i) prohibit, (ii) adopt any restriction that has the effect of prohibiting, or (iii) enforce, or attempt to enforce, any restriction in order to prohibit the display or affixing of one or more religious items on any dwelling unit’s entry door or entry doorframe where such item is displayed or affixed because of a sincerely held religious belief.
(b) It shall not be an unlawful discriminatory practice to (i) prohibit, (ii) adopt any restriction that has the effect of prohibiting, or (iii) enforce, or attempt to enforce, any restriction in order to prohibit the display or affixing of a religious item on any dwelling unit’s entry door or entry doorframe if the religious item:
(1) Threatens public health or safety;
(2) Hinders the opening or closing of the entry door;
(3) Violates any federal, state, or local law or regulation;
(4) Contains any obscene graphics or language; or
(5) Is required to be temporarily removed for the purpose of maintenance to, or repair or replacement of, an entry door or doorframe.
§ 2. This local law takes effect 90 days after it becomes law.
