A Local Law to amend the administrative code of the city of New York, in relation to including environmental concerns as a guiding principle and purpose of the New York city construction codes.

 

Be it enacted by the Council as follows:

                     Section 1.  Statement of findings and purpose.  Environmental concerns are not currently expressly stated as a purpose within the intent provisions of the New York city construction codes, although they are implicitly incorporated within such purposes as concerns affecting the public welfare.  The Council finds that environmental concerns are of sufficient importance to the city that they should be expressly recognized as a guiding principle and interest in the New York city construction codes.

§2.  Section 28-101.2 of the administrative code of the city of New York, as added by local law number 33 for the year 2007, is amended to read as follows:

§28-101.2 Intent. The purpose of this code is to provide reasonable minimum requirements and standards, based upon current scientific and engineering knowledge, experience and techniques, and the utilization of modern machinery, equipment, materials, and forms and methods of construction, for the regulation of building construction in the city of New York in the interest of public safety, health [and], welfare and the environment, and with due regard for building construction and maintenance costs.

                     §3.  Section 101.3 of the New York city plumbing code, as added by local law number 8 for the year 2008, is amended to read as follows:

101.3  Intent.  The purpose of this code is to provide minimum standards to safeguard life or limb, health, property [and], public welfare and the environment by regulating and controlling the design, construction, installation, quality of materials, location, operation and maintenance or use of plumbing systems.

                     §4.  Section 101.3 of the New York city mechanical code, as added by local law number 33 for the year 2007, is amended to read as follows:

101.3 Intent. The purpose of this code is to provide minimum standards to safeguard life or limb, health, property [and], public welfare and the environment by regulating and controlling the design, construction, installation, quality of materials, location, operation and maintenance or use of mechanical systems.

                     §5.  Section 101.4 of the New York city fuel gas code, as added by local law number 33 for the year 2007, is amended to read as follows:

101.4 Intent. The purpose of this code is to provide minimum standards to safeguard life or limb, health, property [and], public welfare and the environment by regulating and controlling the design, construction, installation, quality of materials, location, operation and maintenance or use of fuel gas systems.

                     §6.  This local law shall take effect immediately.
