RESOLUTION NO. 1712

 

Resolution approving the decision of the City Planning Commission on ULURP No. C 080401 ZSM (L.U. No. 920), for the grant of a special permit pursuant to Section 74-681(a)(1) of the Zoning Resolution of the City of New York to allow that portion of the railroad or transit right-of-way which will be completely covered over by a permanent platform to be included in the lot area in connection with the development of two residential buildings on property located at 513 West 55th Street and 520 West 56th Street (Block 1084, p/o Lot 9), in a Large-Scale Residential Development (Block 1083, Lots 1 and 15; and Block 1084, Lot 9), within the Clinton Urban Renewal Area, in an R8 District, within the Special Clinton District, Borough of Manhattan.

                     WHEREAS, the City Planning Commission filed with the Council on October 10, 2008 its decision dated October 7, 2008 (the "Decision") on the application submitted by the New York  City Housing Authority, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-681(a)(1) of the Zoning Resolution to allow that portion of the railroad or transit right-of-way which will be completely covered over by a permanent platform  to be included in the lot area in connection with the development of two residential buildings on property located at 513 West 55th Street and 520 West 56th Street (Block 1084, p/o Lot 9), in a Large-Scale Residential Development (Block 1083, Lots 1 and 15; and Block 1084, Lot 9), within the Clinton Urban Renewal Area, in an R8 District, within the Special Clinton District (ULURP No. C 080401 ZSM), Community District 4, Borough of Manhattan (the "Application");

 

                     WHEREAS, the Application is related to Application Number C 080400 ZSM (L.U. No. 919), a special permit to modify height and setback regulations within the Large-Scale Residential Development;

 

WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;

 

                          WHEREAS, the City Planning Commission has made the findings required pursuant to Section74-681 of the Zoning Resolution of the City of New York;

 

                           WHEREAS, upon due notice, the Council held a public hearing on November 17, 2008 on the Decision and Application;

                           WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, April 22, 2008 (CEQR No. 07CHA007M);

 

                           WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application;                                                                                                                                                                                             

RESOLVED:

 

                     The Council finds that the action described herein will have no significant effect on the environment.

 

                           Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council approves the Decision.
