RESOLUTION NO. 2214

 

Resolution approving the decision of the City Planning Commission on ULURP No. C 090443 ZSK (L.U. No. 1212),  for the grant of a special permit pursuant to Section 74-743 (a) of the Zoning Resolution to modify the requirements of Section 23-145 (For residential buildings developed or enlarged pursuant to the Quality Housing Program), Section 23-852 (Inner court recess), and Section 35-24 (Special Street Wall Location and Height and Setback Regulations in Certain Districts) to facilitate a mixed-use development on property located at 470 Vanderbilt Avenue (Block 2009, Lots 1, 19, 20, 23, 26, 31-44), in a C6-3A District, within a General Large-Scale Development, Borough of Brooklyn.

WHEREAS, the City Planning Commission filed with the Council on September 1, 2009 its decision dated August 19, 2009 (the "Decision"), on the application submitted by the Atara Vanderbilt, LLC, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-743(a) of the Zoning Resolution to modify the requirements of Section 23-145 (For residential buildings developed or enlarged pursuant to the Quality Housing Program), Section 23-852 (Inner court recess), and Section 35-24 (Special Street Wall Location and Height and Setback Regulations in Certain Districts) to facilitate a mixed use development on property located at 470 Vanderbilt Avenue (Block 2009, Lots 1, 19, 20, 23, 26, 31-44), in a C6-3A District, within a General Large-Scale Development (ULURP No. C 090443 ZSK), Community District 2, Borough of Brooklyn (the "Application");

 

                     WHEREAS, the Application is related to ULURP Applications Numbers C 090441 ZMK (L.U. No. 1210), a zoning map amendment changing an M1-1 district and an R6/C2-3 district to a C6-3A district; and N 090442 ZRK (L.U. No.  1211), a zoning text amendment related to apply the Inclusionary Housing Program to R9A districts in Brooklyn Community District;

 

WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;

 

                          WHEREAS, the City Planning Commission has made the findings required pursuant to Section 74-743 (Special provisions for bulk modifications) of the Zoning Resolution of the City of New York;

 

WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on September 22, 2009;

 

 

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and

 

                     WHEREAS, the Council has considered the relevant environmental issues and the Revised Negative Declaration, issued on August 17, 2009 (CEQR No. 09DCP081K);

 

RESOLVED:

 

                     The Council finds that the action described herein will have no significant effect on the environment. 

 

Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, and based on the environmental determination and consideration described in this report, C 090443 ZSK, incorporated by reference herein, the Council approves the Decision.
