Resolution urging the State legislature to amend the State Election Law to require local Boards of Election, including the Board of Elections in the City of New York, to mail two separate notifications to all registered voters, one with information about the primary election in their district and a separate mailing informing voters about the general election.

 

By Council Members Lappin, Dickens, Brewer, Gentile, Liu, Mark-Viverito, Mealy and White Jr.

 

Whereas, New York State Election Law section 4-117 requires local Boards of Election to send notification of upcoming elections to registered voters not less than 65 days nor more than 70 days before the day of the general election in each year; and

Whereas, Among other information, the notification includes the days and hours of the upcoming primary and general elections, the poll site at which the voter is required to vote and a phone number to call for the location of registration and polling places; and

Whereas, Pursuant to section 4-118 of the State Election Law, each county Board of Election is required to publish in two newspapers the weekend before a primary election a notice specifying the day of such primary election, the hours during which it will be held, the public offices for which nominations are to be made and the party positions which are to be filled at such primary election; and

Whereas, The notification the Boards of Election currently send to registered voters does not specifically state whether a primary is taking place or whether a primary is uncontested at a voter’s election district; and

Whereas, Recipients of a Board of Election notification are therefore often confused about whether a primary in addition to the general election is being held in their election district because the notification contains non-specific information; and

                      Whereas, Mailing two separate notifications to voters, one with information on the primary election in their election district and one with information on the general election would remedy this confusing situation; now therefore, be it

Resolved, That the Council of the City of New York urges the State legislature to amend the State Election Law to require local Boards of Election, including the Board of Elections in the City of New York, to mail two separate notifications to all registered voters, one with information about the primary election in their district and a separate mailing informing voters about the general election.
