THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 317

 

Resolution approving with modifications the petition for a revocable consent for an unenclosed sidewalk café located at 2896 Broadway, Manhattan (20065196 TCM; L.U. No. 117).

 

By Council Members Katz and Avella

 

WHEREAS, the Department of Consumer Affairs filed with the Council on March 24, 2006 its approval of the petition dated March 24, 2006 of Deluxe on Broadway, Inc., d/b/a Café Deluxe, for a revocable consent to continue to maintain and operate an unenclosed sidewalk café located at 2896 Broadway, Community District 9, Borough of Manhattan (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");

 

WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code;

 

WHEREAS, upon due notice, the Council held a public hearing on the Petition on May 2, 2006; and

 

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Petition,

 

RESOLVED:

 

Pursuant to Section 20-226 of the Administrative Code, the Council approves the Petition with the following modifications:

 

1.                     The area of the sidewalk café shall extend no more than eight (8) feet, six (6) inches from the building;

 

2.                     The sidewalk café shall have eighteen (18) tables and thirty-six (36) chairs;

 

3.                     The configuration of the tables and chairs shall be nine (9) tables and eighteen (18) chairs either side of the restaurant double door entrance; and

 

4.                     The tables shall be no larger than twenty-one (21) inches in length and twenty-one (21) inches in width.
