A Local Law to amend the administrative code of the city of New York, in relation to creating civil penalties for those who violate the Hate Crimes Act of 2000.

 

Be it enacted by the Council as follows:

 

Section One.  Chapter one of title ten of the administrative code of the city of New York is hereby amended by adding a new section 10-164, to read as follows:

§10-164. Civil Penalties for Violating Hate Crimes Act of 2000.

 

Any person who is convicted of a misdemeanor for violating any provision of Penal Law Article 485 that occurs in New York City shall be liable, to any person or entity injured or aggrieved by such action, for a civil penalty of not less than $1,000 and not more than $5,000. Any person who is convicted of a felony for violating any provision of Penal Law Article 485 that occurs in New York City shall be liable, to any person or entity injured or aggrieved by such action, for a civil penalty of not less than $10,000 and not more than $25,000. Such civil penalties shall be in addition to any criminal penalties and/or sanctions that may be imposed, and such civil penalties shall not limit or preclude any cause of action available to any person or entity injured or aggrieved by such action.

§2. This local law shall take effect immediately.
