A Local Law to amend the administrative code of the city of New York, in relation to providing for baby changing stations in public places.
Be it enacted by the Council as follows:
Section 1. Article ten of subchapter three of chapter one of title 26 of the administrative code of the city of New York is amended by adding a new section 26-252.1 to read as follows:
§26-252.1 Requirement for baby changing stations. a. For the purpose of this section, the term “baby changing station” shall mean an affixed station, area or table with safety straps or other appropriate restraint to secure a baby or young child specifically set aside for changing a diaper on such baby or young child.
b. The owner, lessee, agent or other person directly or indirectly in control of any building or space therein categorized by a use or occupancy classification in table 3-1 shall provide for baby changing stations when the maximum occupancy is greater than or equal to two hundred fifty persons. Baby changing stations shall be provided in buildings or spaces according to the following formula: the greater of either 25% of the total number of urinals and stalls that are assigned to men or 50% of those that are assigned to women. However, in no case shall the required number of baby changing stations be in excess of twenty-five. Such baby changing stations may be designated as unisex, except that baby changing stations not designated as unisex shall be apportioned in a ratio of not more than three accessible solely to one gender to one accessible solely to the other gender . Where baby changing stations number in excess of ten in a building or space, such baby changing stations shall be reasonably allocated throughout the building or space. Baby changing stations at places that are indicated by an asterisk in the table below, which do not have a baby changing station designated as unisex, shall have at least one baby changing station that is accessible solely to men and at least one baby changing station that is accessible solely to women.
c. On or before January twelfth two thousand four, all buildings and spaces therein categorized by a use or occupancy classification in table 3-1 shall provide for baby changing stations in accordance with the provisions of subdivision b of this section.

§2. This local law shall take effect one hundred and twenty days from the date of its enactment, except that the commissioner of buildings shall promulgate any rules and take any other actions necessary for the timely implementation and enforcement of this local law prior to such effective date.
