Title
Resolution approving the decision of the City Planning Commission on ULURP No. M 860117 (D) ZMM, for the fourth modification of Restrictive Declaration D-126, pursuant to Section 5.2 of the Restrictive Declaration, to facilitate the development of a community facility on property located at 405 East 60th Street (Block 1455/Lot 5), in a C6-3 District, Manhattan (L.U. No. 265).

WHEREAS, the City Planning Commission filed with the Council on September 3, 2002 its decision dated September 3, 2002 (the "Decision"), on the application submitted by the Ronald McDonald House of New York, Inc., for the fourth modification of Restrictive Declaration D-126, which was previously approved in connection with an application for a Zoning Map Amendment (C 860117 ZMM), to provide for the development of a mixed-use building on property located on the east side of First Avenue between East 60th and East 61st Streets (Block 1455/Lots 1, 4, and 46), in a C4-7 and a C6-2 District, Community District 8, Borough of Manhattan (ULURP No. M 860117 (D) ZMM) (the "Application");
WHEREAS, the Application is related to ULURP Application Number C 020363 ZSM (L.U. No. 266), a special permit;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;
WHEREAS, the subject application is a request by the Ronald McDonald House of New York, Inc., to modify Restrictive Declaration D-126 as it relates to the subject property to permit the development of a mixed-use building for community facility uses;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on September 17, 2002;
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on April 2, 2002 (CEQR No. 02DCP017M);

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and
RESOLVED:
Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the Decision.
